Terms and Conditions for participation in Quiero Verte Una Vez Mas Tango Festival 2024

These terms and conditions (the “Terms”), apply to all Participants at Quiero Verte Una Vez Mas Tango Festival (the “Festival”). Your attendance at the Festival indicates your agreement to these Terms. By completing the registration on behalf of another individual you are warranting that you have made the Participant aware of these terms and that they have accepted these terms.

 

§ 1 GENERAL PROVISIONS:

  1. These regulations (hereinafter referred to as the "Terms and Conditions" or "Terms") contain rules and regulations for participation sin artistic events (hereinafter referred to as "Events") organized by Fundacja Tango Milonga, running a sole proprietorship under the name of Fundacja Tango Milonga,  ul. Zamknięta 10 lok. 1.5, 30-554 Kraków, NIP: 6762591267, KRS: 0000879003  (hereinafter referred to as the "Organizer") and constitutes an agreement within the meaning of Art.  384 of the Civil Code.

  2.  Participant/Participant: a person fulfilling the conditions of participation in accordance with these Terms & Conditions, who purchased a ticket.

  3. The Terms and any Appendices are made available to each Participant on the Festival's official website and each Participant is required to read and acknowledge them prior to purchasing a ticket. Failure to accept the Terms & Conditions and other documents will prevent access to the area where the Event is taking place.

  4. The Organizer's employees are entitled to prevent participation in the Event or to ask a person who does not comply with the Terms & Conditions and/or Attachments or guidelines on the part of the Organizer's employees servicing the Event to leave the Venue.

 

§ 2 Admissions and Tickets:

  1. These events are private in nature, for which prior registration is required. Admissions without prior registration will be considered at organisers discretion.

  2. Admission to the events of the Festival is granted upon presenting a valid Festival Ticket and filling in a corresponding registration form.

  3. Registrations are per person. Participants registering as a couple need to fill the form separately.

  4. Tickets are sold online prior to the Festival at the official website and are subject to limited availability and to acceptance by the Organisers at its absolute discretion. 

  5. Ticket prices are displayed in EUR 

  6. When purchasing a Ticket for the Festival, Participants are required to provide accurate and complete registration details. It is Participant's responsibility to inform the Organisers of any changes to that information (including, without limitation, your email address) by contacting us via hola@quieroverte.com 

  7. The registration is only valid if confirmed by Organizer via email including a digital ticket.

  8. Tickets may be sold at the door on the day of the Festival subject to availability.

  9. All tickets are non-refundable. You may not sell, transfer, or share your Festival passes. Registered participants may be substituted by other individuals at no extra cost by notice in writing to the organisers prior to the begin of the Festival , subject to organiser's agreement and confirmation. 

  10. The Participant, in accordance with Art. 38 sec. 12 of the Consumer Law Act, has no right to withdraw from the contract for the provision of services related to leisure, entertainment, sports and cultural events, if the contract indicates the day or period of service provision - due to the fact that the Event is of an artistic, and therefore cultural, nature, and the Statement indicates the date when a specific event takes place, the Artist is not entitled to withdraw from the contract.

  11. You must show your ID upon entry to confirm your listing.  

  12. Admission may be refused or revoked at Organisers discretion to persons who do not comply with the Terms, are 

  13. In case of cancellation due to force majeure, full refunds will be provided to all pass types. Refund will be processed using the payment method used during the checkout process. For payments received by credit cards, the same credit card will be refunded. 

 

§ 3 Participation in workshops

  1. Only Participants who purchased relevant tickets and registered for the Workshops can participate in the Workshops

  2. Participants may be refused admission to Workshops if they are late by more than 15 minutes.

  3. Participants may not record audio or video content of the Workshops unless permission is granted by the Teachers 

  4. For workshops in couples only, Participants are required to organise their own Partner. The Organiser takes no responsibility in supplying partners for workshops.

  5.  Individuals who disturb the classes can be dismissed by the Organisers.

 

§ 3 Safe Environment

  1. The Festival has a zero tolerance policy for violence or harassment behaviour. We believe in creating an environment where people in the tango dance community can learn, dance, grow and feel safe. Discrimination or harassment on the basis of sex, gender, national origin, ethnicity, religion, race, sexual orientation, disability or any other ground will not be tolerated. The participants and organisers promise to work together to keep dance spaces and venues safe and welcoming for all people.

  2. Participants who experience discrimination, harassment or violence are invited to trust and approach any organiser of the Festival of their choice on a confidential basis. We will listen attentively and define the measures to be taken together with the person concerned. We believe that we can work together on a trustworthy and confidential basis.

  3. Participants who display violent behaviour will be escorted out with no refund and their admission to any remaining events of the Festivals will be refused.

  4. The area where the Events are held is privately owned and cannot be considered a public space or a generally accessible place.  Only persons who meet the criteria resulting from the Terms, i.e. only previously registered Participants, may stay in this area at certain times. It is forbidden for third parties, regardless of the entity they represent, to move around the premises of the Festival.  In the event of a disruption to the work of the Organsiers or the Organizer's employees, appropriate services will be called immediately with information about obstruction of the work that may be considered harassment by third parties.

  5. The Organizer declares that, for safety reasons, in the event of the intrusion of third parties who are not the Artists or their legal guardians or parents, the Organizer's employees, the area of ​​the Festival will be recorded in the form of audio and video using devices such as a mobile phone, camera, etc., and the recorded materials  may be made available to external entities in the event of a security breach or as a result of financial arrears, which will serve as evidence in the event of legal disputes.  Materials that will not be used in legal disputes will be each time removed within 14 days from their fixation.  It is only a preventive action in order to ensure the highest quality of the organised event.

 

§ 4 Complaints

  1. The Organizer does not provide after-sales services or guarantees.

  2. The Participant may submit a complaint in writing or by e-mail if the Event is not carried out by the Organizer or is carried out contrary to the provisions of the Terms and its attachments.  The Organizer is liable to the Participant in accordance with the general rules of the Civil Code.

  3. The complaint should include:

a) the advertiser's identity data,

b) the subject of the complaint and the period to which the complaint relates,

c) circumstances justifying the complaint,

d) the signature of the claimant - in the case of a complaint submitted in writing.

  1. All complaints should be submitted in writing at the reception desk or by e-mail to the following address: hola@quieroverte.com immediately, no later than within 14 days from the date of the event giving rise to the complaint.  In the case of submitting a complaint by e-mail, the complaint should be sent from the e-mail address indicated in the registration card, otherwise it will not be considered.

  2. The organizer replies to the complaint by e-mail to the e-mail address provided by the complainant or in writing to the address provided by the complainant within 30 days from the date of its receipt.

  3. The organizer may leave the complaint unrecognised if:

a) the complaint concerns a matter explained in the Regulations or attachments.  In this case, the response to the complaint contains a reference to the relevant document,

b) the complaint concerns an issue previously clarified in response to a previous complaint notification of a given Artist.  In this case, the response to the complaint contains a reference to the relevant correspondence,

c) the complaint comes from a third party who does not have the appropriate authorisation or power of attorney,

d) will be submitted after 14 days from the date of disclosure of the reasons for the complaint.

  1. If the complaint does not meet the formal conditions referred to above, the Organizer calls the claimant to supplement it within no more than 7 days, together with an instruction that in the event of failure to complete the complaint within the prescribed period, the complaint will be left without consideration.  The Organizer will immediately inform the claimant about the exercise of the right to leave the complaint unrecognised.

  2. Detailed information on the possibility for the Participant, who is a consumer, to use extrajudicial means of dealing with complaints and redress and the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection,  Provincial Inspectorates of the Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection:

c) http://www.uokik.gov.pl/wazne_adresy.php.

  1. The Participant who is a consumer has the following exemplary possibilities of using out-of-court complaint and redress procedures:

  • may apply to a permanent consumer arbitration court referred to in art.  37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle a dispute arising from the Agreement concluded with the ORGANIZER,

  • may apply to the voivodeship inspector of the Trade Inspection, pursuant to Art.  36 of the Act of December 15, 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between him and the Organizer,

  • may obtain free assistance in resolving the dispute between him and the Organizer, also using the free assistance of a poviat (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers).

 

§ 5 Final provisions

  1.  The rules of participation in the Festival or staying on the premises of the Festival may be supplemented or changed at any time depending on the issued legal acts and new guidelines referred to in § 1 section  2. Each Participant will be notified in advance of any changes. This includes change of venues, timings of Events. All current information can be found on the website: www.quieroverte.com.pl.

  2. Registration for participation in the Event is equivalent to expressing an irrevocable, indefinite consent to the publication of photos or audiovisual materials presenting the Participant on: Event websites, the Organizer, on social media accounts, official photographers and filmmakers of the Event, and their modification.

  3. Registration for participation in the Event is equivalent to accepting these Terms & Conditions.

  4. Smoking is strictly forbidden in all Event venues.

  5. Participants are required to wear dancing shoes or shoes with clean soles in the Festival venues for both Milongas and Workshops.

  6. The organizer reserves the right to refuse booking and admission to any event of the Event at its own discretion, without giving a reason.

  7. Invoices for participation in the Event will be issued upon the participant's request.  If you are interested, please contact us by e-mail.

  8. The organizer is not responsible for any unfortunate accidents during the Event.

  9. The Organizer is not responsible for the destruction or loss of the Participants' property, as well as for damages caused by the Participant during the stay at the Event.

  10. It is forbidden to record or otherwise record dance classes during the Event without obtaining the consent of the Organizer in writing or the consent of the teachers.

  11. The Terms & Conditions apply from April 24th 2023 and remain in force until further notice.
